Please read these terms before approving a quotation or paying a deposit.

1.  About these Terms

These Terms and Conditions (“Terms”) govern all quotations, orders, sales, customisation work, collection and delivery supplied by Naifur Designs (“Naifur Designs”, “we”, “us” or “our”). The person or organisation placing the order is referred to as the “Client” or “you”.

By approving a quotation, confirming an order, paying a deposit or accepting delivery, you confirm that you have read, understood and agreed to these Terms. If a written quotation, invoice or signed order form contains a specific term that differs from these general Terms, the specific written term will apply to that order.

2.  Quotations, Prices and Order Confirmation

  • Quotations remain valid for the period stated on the quotation. If no period is stated, the quotation is valid for 14 calendar days.
  • Prices are in Kenya Shillings unless stated otherwise. Delivery, installation, access equipment, storage and other additional services are excluded unless expressly listed.
  • An order is confirmed only after we receive the required deposit and the Client approves the final design, measurements, materials, colour and quotation in writing or through an agreed digital channel.
  • Any obvious pricing, description or calculation error may be corrected before production begins. We will notify the Client and obtain confirmation before proceeding.

3.  Custom Designs, Materials and Approval

The Client is responsible for carefully checking all approved specifications, including dimensions, orientation, fabric or leather selection, colour, finish, foam, mechanisms, accessories and quantities.

  • Reference photographs and digital renders are guides only. Handmade work may show reasonable differences in stitching, grain, shade, texture, pattern placement and final dimensions.
  • Natural wood, leather, stone and fabric batches vary. Screen settings and lighting can also change how colours appear. These normal variations are not defects.
  • Where an exact material becomes unavailable, we will seek the Client’s approval before using a reasonably comparable substitute.
  • The Client confirms that any design, image or specification supplied for reproduction may lawfully be used. Naifur Designs may make practical construction adjustments needed for safety, strength or functionality while preserving the approved overall design.

4.  Measurements and Site Access

  • The Client must provide accurate room, doorway, corridor, staircase, lift and access measurements unless Naifur Designs has expressly agreed to conduct a site measure.
  • A site visit or measure does not transfer responsibility for concealed obstructions, inaccurate building plans, later site changes or access restrictions that were not reasonably visible.
  • If an item cannot enter or fit because access details or Client-supplied measurements were inaccurate, the Client will meet the reasonable cost of return transport, modification, redelivery or specialist access equipment.

5.  Deposits and Payment

  • The deposit percentage and payment stages will be shown on the quotation or invoice. Production will not begin until cleared funds and all required approvals are received.
  • Deposits for custom-made, personalised or specially sourced items are non-refundable once production, cutting, upholstery, procurement or other committed work has begun, except where Naifur Designs agrees otherwise in writing.
  • The full outstanding balance must be paid in cleared funds before dispatch, delivery or collection unless written credit terms have been approved.
  • Payment is complete only when received through an official Naifur Designs payment channel. The Client should retain the receipt or transaction confirmation.
  • Late payment may pause production or delivery and may change the expected completion date. Any lawful recovery costs will be communicated and documented.

6.  Changes and Cancellations

  • Any change request must be made in writing. A change is effective only after Naifur Designs confirms its feasibility, additional cost and revised completion date.
  • Changes requested after materials have been ordered or work has begun may attract design, labour, material and administrative charges.
  • If the Client cancels a confirmed custom order, Naifur Designs may retain from sums paid the reasonable, documented value of design work, materials ordered, labour completed, supplier commitments and other losses directly caused by the cancellation, subject to applicable law.
  • If we cannot fulfil an order for reasons within our control, our primary remedy will be to agree a suitable replacement, revised arrangement or refund of the affected unfulfilled portion.

7.  Production and Completion Time

Production dates are good-faith estimates, not guaranteed deadlines, unless expressly stated in writing. The estimated period starts after deposit, final approval and any required site information are received.

  • Timelines may change because of approved variations, material shortages, supplier delays, transport disruption, power interruptions, industrial action, public restrictions, extreme weather or other events beyond reasonable control.
  • We will communicate material delays and provide a revised estimate. A reasonable delay does not automatically entitle the Client to cancel a custom order or withhold payment, subject to the Client’s statutory rights.

8.  Delivery, Collection and Storage

  • Delivery charges are based on the agreed location, access conditions and service level. Any later change may require a revised fee.
  • The Client must ensure that an authorised adult is present, the route is clear, and the premises are safe and accessible at the agreed time.
  • Delivery does not include dismantling doors or windows, lifting over balconies, electrical work, wall mounting, moving unrelated furniture or specialist equipment unless expressly agreed.
  • If delivery or collection cannot be completed because the Client is unavailable, the balance is unpaid or access is unsafe or inadequate, reasonable redelivery, handling and storage charges may apply.
  • Completed items should be collected or accepted within 7 calendar days after notice of readiness, unless another date is agreed. After that period, reasonable storage fees may apply. Risk caused by extended storage conditions outside our control passes to the Client once the item is ready.

9.  Inspection and Reporting Issues

  • The Client or authorised representative should inspect the furniture at delivery or collection and record any visible damage, missing item or incorrect specification on the delivery note before signing.
  • Visible issues should be reported promptly and, where reasonably possible, within 48 hours, with the order number, description and clear photographs or video.
  • A signature without a noted exception confirms receipt in apparent good condition, but does not remove any rights that cannot lawfully be excluded, including rights relating to a hidden defect.
  • The Client must allow Naifur Designs a reasonable opportunity to inspect and, where appropriate, repair or replace an affected item before arranging third-party work. Unauthorised repairs may affect warranty coverage where they cause or worsen the problem.

10.  Warranty

Warranty coverage applies only to the component, duration and remedy expressly written on the relevant quotation, invoice or warranty note. If no written warranty is stated, no additional voluntary warranty is given beyond rights and remedies that apply under Kenyan law.

Where a cushion or another specified component is covered, the warranty relates only to a manufacturing defect in that named component; it is not a warranty for the entire furniture item.

Unless a written warranty says otherwise, warranty does not cover:

  • normal wear, settling or softening of foam and cushions, fabric pilling, fading, creasing or natural material variation;
  • cuts, stains, burns, pet damage, pest infestation, mould, water, sunlight, heat, chemical or abrasive cleaning damage;
  • misuse, overloading, jumping, commercial use where domestic use was intended, moving damage, improper assembly or unauthorised alteration or repair;
  • damage caused by an unsuitable environment, uneven flooring, building defects, power surges or failure to follow care instructions; or
  • transport or handling arranged by the Client or a third party after lawful handover.

A valid warranty claim may, at our reasonable option and subject to applicable law, be resolved by inspection, repair, replacement of the affected component or another appropriate remedy. Warranty service does not restart or extend the original warranty period unless confirmed in writing.

11.  Care and Use

  • Follow the care instructions supplied with the product. Use suitable cleaning products and test them on a hidden area first.
  • Protect furniture from direct sunlight, excess moisture, heat sources, sharp objects and excessive weight. Rotate and plump loose cushions regularly.
  • Mechanisms, recliners, storage lifts and adjustable backs must be operated as demonstrated and kept clear of children, clothing and other obstructions.

12.  Returns and Refunds

  • Custom-made, personalised, altered or specially sourced items cannot be returned merely because the Client changes their mind or later prefers a different size, colour or design.
  • Stock items, if any, may be returned only under the written return conditions communicated at purchase and in a resaleable condition, subject to applicable law.
  • Nothing in these Terms limits a Client’s lawful remedies where goods are defective, unsafe, materially different from the approved order or otherwise fail to meet mandatory consumer standards.

13.  Title, Risk and Responsibility

  • Ownership of the goods remains with Naifur Designs until the full purchase price and any agreed charges have been paid.
  • Risk passes to the Client upon delivery to the agreed address or collection by the Client or the Client’s authorised transporter, except where the law provides otherwise.
  • Until ownership passes, the Client must not sell, pledge, materially alter or dispose of the goods.

14.  Limitation of Liability

To the fullest extent permitted by law, Naifur Designs is responsible only for losses that are a reasonably foreseeable and direct result of our breach. We are not responsible for indirect or consequential business losses, loss of profit, or losses caused by inaccurate Client information, unsuitable premises, misuse, unauthorised work or events beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

15.  Client Information and Communication

We may use Client contact, delivery and order information to prepare quotations, produce and deliver furniture, receive payment, provide after-sales support and meet legal or record-keeping obligations. We will handle personal information in accordance with applicable Kenyan data-protection law.

Notices and approvals may be sent through the email address, telephone number, messaging account or other contact channel used for the order. The Client must promptly update changed contact details.

16.  Photography and Intellectual Property

Naifur Designs retains ownership of its original drawings, specifications, templates, branding and design materials unless otherwise agreed in writing. The Client receives the furniture ordered, not a transfer of those intellectual-property rights.

We will request consent before using photographs that identify the Client or reveal private details of the Client’s home. Non-identifying product photographs may be used for quality records or portfolio purposes only where lawful and reasonably respectful of the Client’s privacy.

17.  Complaints and Dispute Resolution

  • A complaint should include the Client’s name, order or invoice number, a clear description of the concern and supporting photographs where relevant.
  • Both parties will first try in good faith to resolve the matter through direct discussion and a reasonable inspection or remedy process.
  • If the matter remains unresolved, either party may propose mediation before court proceedings. This does not prevent either party from seeking urgent relief or using any lawful consumer-redress process.

18.  General

  • These Terms, together with the approved quotation, invoice, order form and written variations, form the entire agreement for the order.
  • If any provision is invalid or unenforceable, the remaining provisions will continue to apply.
  • A failure or delay in enforcing a right is not a waiver of that right.
  • Naifur Designs may update these general Terms from time to time. The version accepted when an order is confirmed will govern that order unless both parties agree otherwise in writing.

19.  Governing Law

These Terms are governed by the laws of Kenya. The courts of Kenya will have jurisdiction, subject to any mandatory consumer-rights process or other dispute-resolution procedure provided by law.
